“When the Husband is Mild, the Wife is Gentle” 夫和妻柔: Marriage Cases in Pre-modern Chinese Legal and Literary Judgments

Pre-modern Chinese law codes assigned precise punishments for specific violations. In reality, however, punishments were not always given out in strict accordance with the codes. Marriage cases in pre-modern China offer us one of the best examples of how the law codes were not dispositive in resolving contentious cases, especially cases that involved highly personal and emotional matters. This talk examines a selection of real and hypothetical cases from the Tang to the Qing dynasty that have to do with marriage disputes. These cases suggest that “law” in pre-modern China was based not only on the formal codes but also on notions of fairness as expressed in classical, historical, and literary texts. These texts gave shape to a law of equity that is only implicit in the law codes.
